Waiver & Release
of Liability
The EDC Remembrance Muster · Memorial Day Weekend
I, the attendee registering for and/or attending the Muster Festival (the “Festival”), acknowledge the risks associated with attendance and participation and agree to the terms set forth in this Waiver and Release of Liability (the “Waiver”). Esprit de Corps Foundation (“EDC”) requires acceptance of this Waiver before I am permitted to participate in Festival activities.

Age Requirement
I attest that I am 17 years of age or older to participate in any 'Murph' Hero WOD heat, Fitness Village activation, or Challenge Range activity. I attest that I am 21 years of age or older to enter the Beer Garden. Attendees under 17 may attend the Festival grounds only under the direct supervision of a parent or legal guardian and may not participate in RX, Scaled, Weighted-Vest, or other high-intensity heats.

Voluntary Participation & Assumption of Risk
I acknowledge that my attendance and participation at The EDC Remembrance Muster (the “Festival”) is voluntary and involves inherent risk of injury, illness, permanent disability, and death. I knowingly and freely assume all risks of attendance and participation, both known and unknown, even if arising from the negligence of Esprit de Corps Foundation (“EDC”), its affiliates, venue hosts, sponsors, contractors, and all of their respective directors, officers, members, agents, volunteers, and employees (collectively, the “EDC Parties”).

Physical Fitness
I attest that I am physically fit and prepared for the activities I choose to participate in. I have consulted a healthcare professional to the extent necessary. I understand that the 'Murph' Hero WOD and related fitness activities are demanding and that I am responsible for choosing a heat and workload appropriate for my current level of conditioning.

Communicable Illness
I acknowledge the risk that I may be exposed to or infected by communicable illnesses (including but not limited to COVID-19, influenza, and MRSA) by attending and participating in the Festival, and that such exposure or infection may result in personal injury, illness, permanent disability, or death. I agree not to attend the Festival if, in the fourteen (14) days prior, I have tested positive for or have a suspected case of a communicable illness, experienced related symptoms, or been in close contact with a person known to have such an illness.

Compliance with Rules
I agree to comply with all EDC and venue rules, staff and volunteer instructions, and posted signage. If I observe an unusual or significant hazard, I will remove myself from participation and promptly report the hazard to the nearest Festival official.

Personal Property
I acknowledge that the Festival does not provide storage for personal items and that I am solely responsible for my personal property. EDC is not liable for the loss, theft, or damage of personal property, including items left anywhere on Festival grounds.

Registration, Tickets, & Refunds
All registrations and paid tickets, once purchased, are FINAL SALE, NON-TRANSFERABLE, and NON-REFUNDABLE. EDC reserves the right, in its sole discretion, to postpone, cancel, or modify the Festival due to factors beyond its control, including without limitation weather, force majeure, venue changes, or public-health directives. In the event of postponement, cancellation, or material modification, EDC will notify registered attendees via the email address associated with their registration.

Beer Garden & Alcohol
The Beer Garden is a designated 21+ area. Government-issued photo identification is required for entry. I agree not to bring outside alcohol or illegal substances onto Festival grounds and acknowledge that I am solely responsible for any consequences of my consumption of alcohol at the Festival, including any damage suffered by me or caused to third parties.

Photo, Video, & Media Release
I irrevocably grant EDC and the EDC Parties unlimited permission to photograph, film, record, reproduce, publish, distribute, and otherwise use any images, video, audio, likeness, or voice recording of my participation in the Festival for any lawful purpose in perpetuity, including but not limited to marketing, promotion, grant applications, and organizational communications, without further notice or compensation to me.

Community Media Uploads
If I upload photos or videos to the The EDC Remembrance Muster community gallery (or otherwise submit media to EDC): (a) I represent and warrant that I own the media or have obtained all rights and permissions necessary to submit it, including from every person identifiable in the media; (b) I grant EDC a worldwide, perpetual, royalty-free, transferable, sublicensable, and irrevocable license to display, host, reproduce, edit, publish, distribute, and use the media across any medium now known or later developed, including the EDC website, social channels, grant applications, sponsor decks, and marketing, without further notice or compensation to me; (c) I release EDC and the EDC Parties from any and all claims arising from EDC's use of the media consistent with this license; and (d) I understand EDC may decline to publish, remove, or edit any submitted media in its sole discretion.

Non-Distribution of Recordings
I acknowledge that I am not permitted to use, reproduce, sell, or distribute any photographs, video, or recordings of the Festival or of other attendees for commercial purposes without prior written permission from EDC.

Distribution of Materials
Distribution of promotional, educational, or sales materials at the Festival is prohibited unless approved in writing in advance by EDC. Violations may result in removal from the Festival without refund.

Release & Hold Harmless
For myself and on behalf of my heirs, assigns, personal representatives, and next of kin, I hereby release and hold harmless the EDC Parties from all liabilities, costs, expenses, claims, demands, injuries, disability, death, and loss or damage to person or property arising out of or related to my attendance and participation at the Festival, whether arising from their negligence or otherwise, to the fullest extent permitted by law.

Governing Law & Venue
This waiver is governed by the laws of the State of Illinois. Any action arising out of this waiver or the Festival shall be brought exclusively in the state or federal courts located in Cook County, Illinois.

Severability
If any term of this waiver is found to be unenforceable or void, in whole or in part, the offending term shall be construed as valid and enforceable to the maximum extent permitted by law, and the balance of this waiver shall remain in full force and effect.

Acknowledgment
I have read this Waiver and Release of Liability, fully understand its terms, and understand that I am giving up substantial rights including my right to sue the EDC Parties under certain circumstances. I acknowledge that acceptance may be given electronically at registration and/or by signature at the Festival check-in table, and that both forms constitute my binding agreement.
